Terms of Use

These Terms of Use ("Terms") apply to the iPhone app Dog Is Eating (the "App"), offered by MWF Ware, sole proprietorship of Martin Müller, Buttmannstraße 7A, 13357 Berlin, Germany ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. What the App is
Dog Is Eating is a focus timer. While a session runs, an animated beagle eats biscuits. If you leave the App, he barks and the App can remind you with a local notification. The App is for motivation and entertainment.
The App is not a medical device. It does not diagnose, treat, cure or prevent ADHD or any other condition, and it is no substitute for professional advice. "ADHS" or "ADHD" in the App's name or listing describes who might find it useful, not a medical purpose.
2. Your licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. You may not copy, modify, reverse engineer, resell or redistribute the App, except where the law expressly allows it.
3. Free use and Pro
The App is free to download. Without Pro, sessions can last up to 5 minutes. Pro unlocks sessions of up to 90 minutes. Pro is offered as:
- auto-renewing subscriptions (monthly, every 3 months, yearly), and
- one-time purchases (Lifetime, and Lifetime Family for your Apple Family Sharing group).
Prices are shown in the App and in the App Store before you buy, in your local currency.
4. Purchases and subscriptions
- All payments are processed by Apple through your Apple Account. Apple's terms apply to payment, billing and refunds.
- Subscriptions renew automatically at the end of each period at the then current price unless you cancel at least 24 hours before the period ends. You can manage or cancel subscriptions in Settings › your name › Subscriptions on your iPhone.
- Cancelling stops future renewals. Pro stays active until the end of the period you already paid for.
- Refunds are handled by Apple. You can request one at reportaproblem.apple.com. Statutory rights of withdrawal and warranty remain unaffected.
- To restore purchases on a new device, use "Restore purchases" in the App with the same Apple Account.
5. Notifications
If you allow notifications, the App schedules local reminders on your device when you leave a running session. You can turn reminders and the bark sound off in the App's settings or in iOS Settings at any time.
6. Fair use
Do not use the App in a way that breaks the law or harms others. Please do not use it when your attention is needed elsewhere for safety, for example while driving.
7. Intellectual property
The App, its artwork, animations, texts and design belong to us or our licensors. Third-party components are used under their own licences (for example the Schoolbell font under the Apache License 2.0 and bark sounds released as CC0).
8. Availability and changes
We work to keep the App running well but cannot promise that it will always be available or free of errors. We may update the App to fix problems or improve it. Features you paid for will not be taken away without a fair replacement or as required by law.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and as required by mandatory product liability law. For slight negligence we are only liable for breaches of essential contractual obligations and limited to damage that was typical and foreseeable. Otherwise our liability is excluded. Nothing in these Terms limits rights you have under mandatory consumer law.
10. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple is not responsible for addressing claims by you or third parties relating to the App, including product liability, legal or regulatory claims and consumer protection claims. In the event of a third-party claim that the App infringes intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim. You confirm that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Law
These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection laws of the country where you live still apply.
12. Changes to these Terms
We may update these Terms, for example when the App changes or the law requires it. The current version is always on this page. Important changes will be announced in the App.
